If the veteran fails to pay, they can be held in contempt of court--VA disability pay is subject to garnishment only if the veteran waived military retired pay to receive VA disability benefits. military retired pay is a marital asset and is subject to division by the divorce court. However, if the former spouse is awarded a percentage, their benefits will be increased when cost-of-living adjustments are applied. , a percentage of disposable retired pay (gross retired pay less allowable deductions).

A divorce court may have jurisdiction over a divorce case under state law but still not have the power to divide military retirement benefits unless the service member or former service member consents.

Following the 2017 Tax Cuts and Jobs Act (TCJA), the federal tax rules for alimony have changed significantly, but the impact depends on when the divorce or separation agreement was finalized

What are the Tax Implications of Alimony for the Recipient?

  • Alimony received is considered taxable income: As mentioned above, the recipient must report the alimony payments they receive as taxable income on their federal tax return. This will increase their taxable income and could push them into a higher tax bracket, resulting in a higher overall tax bill.
  • Alimony payments are not subject to Social Security and Medicare taxes: Unlike wage income, alimony payments are not subject to Social Security and Medicare taxes. This means the recipient will not have to pay these taxes on the alimony payments they receive.

An in-ground burial at Arlington National Cemetery Arlington National Cemetery does not charge fees for an interment or inurnment at the cemetery. Effective December 2017, placement of private markers is no longer available for service members and families. Joe will have military honors.

The U.S. government will provide, at no cost to the estate of the deceased, an upright, white marble headstone or white marble niche cover. Upright white marble headstones (13" x 42" x 4") generally contain 11 lines of text, with or without an emblem of belief. Generally, the stone can accommodate 13 characters (including spaces) on the name line, and 15 characters (including spaces) on all other lines. A veteran's government headstone must contain the deceased's name, rank, branch of service, date of birth and date of death. Other lines can include combat service and significant awards. An additional inscription, not to exceed three lines, can include a term of endearment or reference (e.g. Loving Father, Husband, and Son; Fought for Freedom; Proud Soldier). To check the status of a headstone/niche cover order call 1-877-907-8585.

When the family or funeral home makes the first call to the customer service center, they are given a case number for tracking purposes and are asked to fax or e-mail all required documents for review. Who’s eligible for burial in a VA national cemetery?

Veterans, service members, spouses, and dependents may be eligible for burial in a VA national cemetery, as well as other benefits, if they meet one of these requirements.

One of these must be true:

  • The person qualifying for burial benefits is a Veteran who didn’t receive a dishonorable discharge, or
  • The person qualifying for burial benefits is a service member who died while on active duty, active duty for training, or inactive duty for training, or
  • The person qualifying for burial benefits is the spouse or surviving spouse of a Veteran (even if they remarried after the Veteran’s death), or

Funeral services without military honors are for spouses or dependents of military members who are eligible to be buried at Arlington National Cemetery (ANC). A military chaplain may be requested at no additional cost to the family, if no civilian religious leader will be present.

On September 26, 2025 no fees are needed to spouse buried. You need the marriage certificate to meet doucment requirements.

One-time Lump-Sum Death Payment If you’ve worked long enough, we make a one-time payment of $255 when you die. We can only pay this benefit to your spouse or child if they meet certain requirements. Survivors must apply for this payment within 2 years of the date of your death.

The information we need includes:
• Proof of death — either from a funeral home or a death certificate.
• Your SSN, and the deceased worker’s SSN.
• Your birth certificate.
• Your marriage certificate if you’re a surviving spouse.
• Your divorce papers if you’re applying as a surviving divorced spouse.
• Dependent children’s SSNs, if available, and birth certificates.
• Deceased worker’s W-2 forms or federal self-employment tax return for the most recent year.
• The name of your bank and your account number so your benefits can be deposited directly into your account

In most typical claims for benefits a: • Surviving spouse, at full retirement age or older, generally gets 100% of the worker’s basic benefit amount.

For anyone born 1962 or later, full survivors’ benefits are payable at age 67.

You could get a monthly payment based on the work history of the family member who died. File and suspend

Before the change:

  • A worker at full retirement age or older applied for retirement benefits and then voluntarily suspended payment of their retirement benefits.

  • The worker’s voluntary suspension permitted a spouses benefit to be paid to their spouse while the worker was not collecting retirement benefits.
  • The worker would then restart their retirement benefits later, for example at age 70, with an increase for every month retirement benefits were suspended.

 

5 Things every woman should know about retirement | PDF There is a law in relations to the deeming rule.
